SuperFan Club Terms and Conditions of Membership

  1. Introduction
    1. SuperFan Club (“Our Site”) is owned by Turner Broadcasting System Europe Limited (We/Us/Our), a limited company registered in England under company number 1927955, of 16 Great Marlborough Street, London, W1F 7HS.
    2. Superfanclub.com AND SuperFan Club are managed on Our behalf by Tribes Research Limited (Tribes). Tribes Research Limited is a company registered in England and Wales with company number 08385662, whose registered address is 3-4 Bower Terrace, Tonbridge Road, Maidstone, Kent, ME16 8RY, and whose main trading address is Surrey Technology Centre, Surrey Research Park, Guildford, Surrey, GU2 7YG.
    3. By becoming a member and agreeing to these Terms, you agree to be bound by these Terms, including any changes to them or the Site in accordance with these Terms. If you do not agree to these Terms you must not apply for membership of the SuperFan Club.
    4. This website uses cookies. By using the website and agreeing to these terms of use, you consent to our use of cookies in accordance with the terms of our privacy and cookies policy.
  2. Membership of SuperFan Club
    1. Membership of the SuperFan Club community is only open to residents of the UK who are 18 years of age or over and are the parent and/or legal guardian of one (1) or more children aged between four (4) to twelve (12).
    2. Membership of the SuperFan Club is free.
    3. Membership is personal to you and is not transferable.
    4. You may only join the SuperFan Club once
    5. Membership of the SuperFan Club allows access to Cartoon Network and Boomerang content that may not be generally available and from time to time may entitle you to various incentives, including but not restricted to prize draws. We will ask members and their children to take part in surveys or answer questions about the content on the Site and on Cartoon Network and Boomerang sites and services generally.  Taking part in any survey or other activity is voluntary. However, as membership of the community is limited we reserve the right to terminate membership if members do not participate in surveys or activities.  For each incentive, competition or prize draw we will provide terms and conditions please review them before taking part.
    6. We reserve the right to refuse any membership applications.
    7. When you take part in the registration survey or from time to time you will be asked to provide certain information about you and your child/children. Our use of this information is covered by our Privacy Policy.
    8. From time to time we will email you to ask you to take part in a survey or other research project relating to Cartoon Network, Boomerang, characters, programmes, games and/or other content. We may ask you to ask your children to respond to a survey. Response to surveys is optional and you can opt out of receiving reminders for each survey by logging into the SuperFan Club site and going to the Profile page on the site https://superfanclub.com/profile/.
    9. The Site may be accessed anonymously as a visitor. To access certain services and content, such as feedback information, you are required to register as a member of the community.
  3. Marketing communications
    1. As part of the registration process we will ask you if you want to receive communications from us by email about Cartoon Network and Boomerang. If you opt in you can opt out at any time by going to the Profile page on the site https://superfanclub.com/profile/.
  4. Termination
    1. We may suspend or terminate your membership of the SuperFan Club:
      1. a) Immediately on written notice if you are in breach of this agreement;
      2. b) At any time by giving you thirty (30) days’ notice by email; or
      3. c) If you fail to take part in surveys in any six (6) month period.
      4. d) If your child/children are older than 12.
    2. You can terminate this agreement at any time by unsubscribing from the SuperFan Club by email to support@superfanclub.com or by going to the unsubscribe section of the website
  5. Terms and Conditions of Website Use

  6. Licence to use website
    1. Users may only use the Site for personal use and not for any commercial purpose. We grants visitors to the Site a limited, non-exclusive, non-transferable license to access and use the Site solely as provided for in these Terms. We grant visitors and SuperFan Club members a limited, non-exclusive, non-transferable, royalty-free license to access, use, and privately display the the Site on personal internet-connected devices.
    2. All copyright, trademarks and other intellectual property rights in the Site and all associated material or content provided on or in connection with the Site will remain ours or, where applicable, our third-party content partners. No rights in any content are transferred to you unless expressly provided otherwise in these Terms.
    3. You must not:
      • (a) make unauthorised recordings of any content, or otherwise copy, reproduce, distribute, transfer, sell, license, publish, enter into a database, display, perform publicly, modify, create derivative works, upload, edit, publish, post, link to, frame, transmit, rent, lease, lend or sublicense or in any way exploit any part of the Site or any content (except as permitted under any applicable legislation);
      • (b) make any direct or indirect charge for watching or using any part of the content;
      • (c) exhibit any content or any part of the Site for a commercial purpose or in public to an audience, even if no direct or indirect charge is made;
      • (d) attempt to breach any security or content protection rules relating to the Site, or compromise the security of any content; and/or
      • (e) access or use the Site or content, including the interface as well as all functionalities and features, for any improper, unauthorised or unlawful purpose or allow anyone else to do so.
      • (f) use this website to copy, store, host, transmit, send, use, publish or distribute any material which consists of (or is linked to) any spyware, computer virus, Trojan horse, worm, keystroke logger, rootkit or other malicious computer software.
      • (g) conduct any systematic or automated data collection activities (including, without limitation, scraping, data mining, data extraction and data harvesting) on or in relation to this website without the express written consent of Us.
      • (h) use this website to transmit or send unsolicited commercial communications.
      • (i) use this website for any purposes related to marketing without the express written consent of Us.
    4. You are responsible for all activity which takes place via your registration, including maintaining the confidentiality of your email address and password.
  7. Content
    1. From time to time We may make available to members of the SuperFan Club programmes or games on an exclusive basis. Programmes on the Site will be as originally produced and may be different from versions that are broadcast or will be broadcast on television or on demand services. We may display age ratings from time to time where content is not recommended for all ages.
  8. Changes to the Service
    1. The content will change regularly. We will add, remove or change content from time to time. We do not guarantee the availability of any particular content. Some content included in the Site is supplied by other organisations and may be changed or removed due to matters outside our reasonable control.
    2. From time to time, we may choose to make changes or enhancements to the Site (“Service Updates”). These Service Updates may vary, replace or withdraw any service, feature or functionality or channel or content provided as part of the Site at any time. We may also make Service Updates in order to repair, maintain or update the Site, including software updates and bug fixes. Note that the Site may be temporarily unavailable during a Service Update.
    3. Service Updates may be:
      • (a) automatic, such as in connection with general Site changes and additional features or updates to the Service;
      • (b) optional and at the election of members in which case members will receive information and instructions for how to authorise optional Service Updates; or
      • (c) mandatory, in which case members will be required to consent to the Service Update or install or upgrade a third-party plug-in if they wish to maintain continued access to the Site.
    4. We provide the services on an ongoing basis and we cannot foresee what may change in the future. This means we may make changes other than those set out in these Terms including as to the technical requirements of the Site, the number of registered devices or concurrent streams.
    5. Note that it may not be practical for us to notify you in advance of all Service Updates, for example for every change in content. You should keep checking the Site for details of the content available.
    6. We will try to make sure that changes we make to our Site or terms will not adversely affect you. If changes are likely to adversely affect you, we will notify you of any such changes at least 30 days before the change,. If we have to make a significant change to the Site which will adversely affect you, we will give you notice and the right to cancel your membership. If you do not cancel after we have notified you about any changes and before these changes take place, and you continue to use the Site, we will take that as your acceptance of the change.
  9. Limited warranties
    1. We do not warrant the completeness or accuracy of the information published on this website; nor do we commit to ensuring that the website remains available or that the material on the website is kept up to date.
    2. To the maximum extent permitted by applicable law, we exclude all representations, warranties and conditions relating to this website and the use of this website (including, without limitation, any warranties implied by law in respect of satisfactory quality, fitness for purpose and/or the use of reasonable care and skill).
  10. Limitations and exclusions of liability
    1. Nothing in these terms of use will: (a) limit or exclude our or your liability for death or personal injury resulting from negligence; (b) limit or exclude our or your liability for fraud or fraudulent misrepresentation; (c) limit any of our or your liabilities in any way that is not permitted under applicable law; or (d) exclude any of our or your liabilities that may not be excluded under applicable law.
    2. The limitations and exclusions of liability set out in this Section and elsewhere in these terms of use: (a) are subject to the preceding paragraph; and (b) govern all liabilities arising under these terms of use or in relation to the subject matter of these terms of use, including liabilities arising in contract, in tort (including negligence) and for breach of statutory duty.
    3. Subject to clause 9.1, to the extent that the website and the information and services on the website are provided free of charge, we will not be liable for any loss or damage of any nature.
    4. Subject to clause 9.1, We will not be liable to you in respect of any losses arising out of any event or events beyond our reasonable control.
    5. We will not be liable to you in respect of any business losses, including (without limitation) loss of or damage to profits, income, revenue, use, production, anticipated savings, business, contracts, commercial opportunities or goodwill.
    6. We will not be liable to you in respect of any loss or corruption of any data, database or software.
    7. We will not be liable to you in respect of any special, indirect or consequential loss or damage.
  11. Indemnity
    1. You hereby indemnify us and undertake to keep us indemnified against any losses, damages, costs, liabilities and expenses (including, without limitation, legal expenses and any amounts paid by us to a third party in settlement of a claim or dispute on the advice of our legal advisers) incurred or suffered by us arising out of any breach by you of any provision of these terms of use, or arising out of any claim that you have breached any provision of these terms of use.
  12. Breaches of these terms of use
    1. Without prejudice to our other rights under these terms of use, if you breach these terms of use in any way, we may take such action as we deem appropriate to deal with the breach, including suspending your access to the website, prohibiting you from accessing the website, blocking computers using your IP address from accessing the website, contacting your internet service provider to request that they block your access to the website and/or bringing court proceedings against you.
  13. Variation
    1. We may revise these terms of use from time to time. Revised terms of use will apply to the use of our website from the date of publication of the revised terms of use on our website.
  14. Assignment
    1. We may transfer, sub-contract or otherwise deal with our rights and/or obligations under these terms of use without notifying you or obtaining your consent.
    2. You may not transfer, sub-contract or otherwise deal with your rights and/or obligations under these terms of use.
  15. Severability
    1. If a provision of these terms of use is determined by any court or other competent authority to be unlawful and/or unenforceable, the other provisions will continue in effect. If any unlawful and/or unenforceable provision would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the provision will continue in effect.
  16. Exclusion of third party rights
    1. These terms of use are for the benefit of you and Us and are not intended to benefit any third party or be enforceable by any third party. The exercise of our and your rights in relation to these terms of use is not subject to the consent of any third party.
  17. Entire agreement
    1. These terms of use, together with our privacy and cookies policy, constitute the entire agreement between you and us in relation to your use of our website and supersede all previous agreements in respect of your use of our website.
  18. Law and jurisdiction
    1. These terms of use will be governed by and construed in accordance with English law, and any disputes relating to these terms of use will be subject to the exclusive jurisdiction of the courts of England and Wales.
